Law Enforcement Report

I know, it's a day early, but I just couldn't wait. Here is a report from a local Sheriff's office:

"12:10 a.m. Deputy [name removed] pulled over a man on Highway [number removed]. The man had a hard time standing up, stunk of booze and had blood shot eyes. He also admitted drinking. The deputy suspected the man of being drunk, but the man refused to take field sobriety tests. "He stated that he was too drunk to do them," wrote the deputy in a report. The man was charged with DWI and refusal to take the tests."

Now, it's after midnight, the man can't stand up, stinks of booze, has blood shot eyes, and admits to being too drunk. The DWI charge is going to stick and is going to haunt the man for a long, long time. WHY then, would the deputy charge him with a refusal to take the sobriety test? Utter silliness.
